Data protection declaration

This data protection declaration explains the nature, scope and purpose of the processing of personal data (hereinafter referred to as "data") in the context of the provision of our services as well as within our online offer and the associated websites, functions and content as well as external online presences, such as our social media profile (hereinafter jointly referred to as "online offer"). With regard to the terms used, such as "processing" or "controller", we refer to the definitions in Article 4 of the General Data Protection Regulation (GDPR).

Types of data processed

Categories of affected persons

Visitors and users of the online offer (hereinafter we refer to the persons concerned collectively as "users").

Terms used

"Personal data" means any information relating to an identified or identifiable natural person ("data subject"); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier (e.g. cookie) or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.'"Processing" means any operation or set of operations which is performed on personal data or on sets of personal data, whether or not by automated means. Authoritative legal bases

In accordance with Article 13 GDPR, we shall inform you of the legal bases of our data processing operations. For users from the scope of the General Data Protection Regulation (GDPR), i.e. the EU and the EEC, the following applies, unless the legal basis is mentioned in the data protection declaration:
The legal basis for obtaining consent is Article 6(1)(f) GDPR. a and Art. 7 GDPR;
The legal basis for processing for the fulfilment of our services and the implementation of contractual measures as well as answering inquiries is Article 6(1)(f) GDPR. b GDPR;
The legal basis for processing to fulfil our legal obligations is Article 6(1)(f) GDPR. c GDPR;
In the event that vital interests of the data subject or another natural person require the processing of personal data, Article 6(1)(f) GDPR applies. D GDPR as the legal basis.
The legal basis for the processing required for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller is Article 6(1)(f) GDPR. e GDPR.

The processing of data for purposes other than those for which they were created is governed by the requirements of Article 6 (4) GDPR.
The processing of special categories of data (in accordance with Article 9 (1) GDPR) is governed by the provisions of Article 9 (2) GDPR.

Security

We meet in accordance with the statutory requirements, taking into account the state of the art, the implementation costs and the nature, scope, circumstances and purposes of processing, as well as the different probability of occurrence and severity of the Risk to the rights and freedoms of individuals, appropriate technical and organisational measures to ensure a level of protection appropriate to the risk.Measures include, in particular, ensuring the confidentiality, integrity and availability of data by controlling physical access to the data, as well as access to it, entering, sharing, ensuring availability and its Separation. We have also established procedures to ensure a perception of affected rights, deletion of data and response to data exposure. Furthermore, we take into account the protection of personal data already in the development or selection of hardware, software and procedures, in accordance with the principle of data protection through technology design and data protection-friendly default settings.

Working with contract processors, jointly responsible and third parties

If, in the context of our processing, we disclose data to other persons and companies (processors, joint controllers or third parties), transmit them to them or otherwise grant them access to the data, this will only be done on the basis of a legal permission (e.g. if a transmission of the data to third parties, such as payment service providers, is necessary for the fulfilment of the contract), users have consented, a legal obligation provides for this or on the basis of our legitimate interests (e.g. when using agents, web hosts, etc.).If we disclose, transmit or otherwise grant access to other companies in our group of companies, this is done in particular for administrative purposes as a legitimate interest and beyond that on a legal basis. Transfers to third countries

If we process data in a third country (i.e. outside the European Union (EU), the European Economic Area (EEA) or the Swiss Confederation) or this is done in the context of the use of third-party services or disclosure, or transmission of data to other persons or companies, this will only be done if it is necessary to fulfil our (pre)contractual obligations, on the basis of your consent, is based on a legal obligation or on the basis of our legitimate interests. Subject to legal or contractual permits, we process or leave the data in a third country only if the legal requirements are met. This means that the processing takes place, for example, on the basis of special guarantees, such as the officially recognized level of data protection corresponding to the EU (e.g. for the USA through the "Privacy Shield") or compliance with officially recognized special contractual obligations.

Rights of the persons concerned

You have the right to request confirmation as to whether the data in question is processed and for information about this data, as well as on further information and copy of the data in accordance with the legal requirements.You have accordingly. Cookies and the right to object to direct advertising

"Cookies" are small files that are stored on users' computers. Different information can be stored within the cookies. A cookie is primarily used to store the information about a user (or the device on which the cookie is stored) during or after his visit within an online offer. Temporary cookies, or "session cookies" or "transient cookies", are cookies that are deleted after a user leaves an online offer and closes his browser. In such a cookie, for example, the contents of a shopping cart can be stored in an online shop or a login status. "Permanent" or "persistent" cookies are cookies that remain stored even after closing the browser. For example, the login status can be saved if the users visit them after several days. Similarly, such a cookie can store the interests of users used for range measurement or marketing purposes. "Third-party cookies" are cookies that are offered by providers other than the person responsible for operating the online offer (otherwise, if they are only their cookies, one speaks of "first-party cookies").We may use temporary and permanent cookies and make up for this as part of our privacy policy.If users do not want cookies to be stored on their computer, they are asked to disable the option in their browser's system settings. Saved cookies can be deleted from the browser's system settings. Deletion of data

The data we process will be deleted or restricted in processing in accordance with the legal requirements. Unless expressly stated in the context of this Privacy Statement, the data stored with us will be deleted as soon as it is no longer necessary for its purpose and no legal retention obligations stand in the way of deletion.Unless the data is deleted because it is necessary for other and legally permissible purposes, its processing will be restricted. This means that the data is blocked and not processed for other purposes. This applies, for example, to data that must be retained for commercial or tax reasons.

Changes and updates to the Privacy Statement

We ask you to check the content of our privacy policy on a regular basis. We adjust the privacy policy as soon as the changes to the data processing we do make this necessary. We will inform you as soon as the changes require an act of participation on your part (e..B. consent) or any other individual notification.

Business-related processing

In addition, we
process

Registration function

Users can create a user account. As part of the registration, the required mandatory information is communicated to the users and on the basis of Article 6 (1) lit. b GDPR processed for the purpose of providing the user account. The data processed includes, in particular, the login information (name, password and an e-mail address). The data entered as part of the registration will be used for the purpose of using the user account and its purpose.Users may be informed by e-mail about information relevant to their user account, such as technical changes. If users have terminated their user account, their data will be deleted with respect to the user account, subject to a legal retention obligation. It is incumbent on users to secure their data before the end of the contract if they are terminated. We are entitled to irretrievably delete all user data stored during the duration of the contract.As part of the use of our registration and registration functions as well as the use of the user account, we store the IP address and the time of the respective user business. The storage is based on our legitimate interests, as well as the user in terms of protection against abuse and other unauthorized use. In principle, this data will not be passed on to third parties, unless it is necessary to pursue our claims or there is a legal obligation to do so in accordance with Article 6 (1) lit. c. GDPR. The IP addresses will be anonymized or deleted after 7 days at the latest.

DISQUS comment function

On the basis of our legitimate interests in efficient, secure and user-friendly comment management in accordance with Article 6 (1) lit. f. DSGVO the comment service DISQUS, offered by DISQUS, Inc., 301 Howard St, Floor 3 San Francisco, California- 94105, USA. DISQUS is certified under the Privacy Shield Agreement and thus offers a guarantee to comply with European data protection law: https://www.privacyshield.gov/participant?id=a2zt0000000TRkEAAW&status=Active.To use the DISQUS comment function, users can log in via their own DISQUS user account or an existing social media account (e.g. OpenID, Facebook, Twitter or Google). In this case, the login data of the users are obtained by DISQUS from the platforms. It is also possible to use the DISQUS comment function as a guest, without creating or using user accounts with DISQUS or one of the specified social media providers.We only embed DISQUS with its functions in our website, whereby we can influence the comments of the users. However, the users enter into a direct contractual relationship with DISQUS, within the framework of which DISQUS processes the comments of the users and is a contact person for any deletion of the users' data. We refer to the privacy policy of DISQUS: https://help.disqus.com/terms-and-policies/disqus-privacy-policy and also point out to users that they can assume that DISQUS stores their IP address and the time of the comment in addition to the comment content and stores cookies on the users' computers and can use them to display advertising. However, users may object to the processing of their data for the purpose of displaying advertisements: https://disqus.com/data-sharing-settings.

Comments and posts

If users leave comments or other contributions, their IP addresses may be processed on the basis of our legitimate interests within the meaning of Article 6(1)(f) GDPR. f. DSGVO for 7 days. This is done for our safety if someone leaves illegal content in comments and posts (insults, forbidden political propaganda, etc.). In this case, we can be prosecuted for the comment or contribution ourselves and are therefore interested in the identity of the author.Furthermore, we reserve the right, on the basis of our legitimate interests pursuant to Article 6 (1) lit. f. GDPR, to process the information provided by users for the purpose of spam detection.On the same legal basis, we reserve the right, in the case of surveys, to store users ' IP addresses for their duration and to use cookies to avoid multiple votes.The information about the person, any contact and website information as well as the content information provided in the context of the comments and contributions will be stored by us permanently until the user is at odds.

Comment subscriptions

The follow-up comments can be submitted by users with their consent in accordance with Article 6 (1) lit. (GDPR). Users will receive a confirmation email to check that they are the owner of the email address they enter. Users can opt out of ongoing comment subscriptions at any time. The confirmation email will include hints about the revocation options. For the purposes of proving user consent, we store the registration date as well as the users ' IP address and delete this information when users opt out of the subscription.You can cancel the receipt of our subscription at any time, i.e. withdraw your consent. We may store the emailed addresses issued for up to three years on the basis of our legitimate interests before deleting them in order to prove prior consent. The processing of this data is limited to the purpose of a possible defense against claims. An individual deletion request is possible at any time, provided that the former existence of consent is confirmed at the same time.

Retrieving profile pictures at Gravatar

Within our online offer and in particular in the blog, we use the Gravatar service of Automattic Inc., 60 29th Street #343, San Francisco, CA 94110.Gravatar is a service where users can log in and store profile pictures and their email addresses. If users with the respective e-mail address leave posts or comments on other online stores (especially in blogs), their profile pictures can be displayed next to the posts or comments. For this purpose, the e-mail address provided by the users to Gravatar is transmitted encrypted in order to check whether a profile is stored with it. This is the sole purpose of transmitting the e-mail address and it is not used for other purposes, but then deleted.The use of Gravatar is based on our legitimate interests within the meaning of Article 6(1)(f) GDPR. (f) GDPR, as with the help of Gravatar we offer the post and comment authors the opportunity to personalize their contributions with a profile picture.By displaying the images, Gravatar brings users ' IP address to know, as this is necessary for communication between a browser and an online service. Further information on the collection and use of data by Gravatar can be found in Automattic's privacy policy: https://automattic.com/privacy/.If users do not want a user image linked to your email address at Gravatar to appear in the comments, you should use an e-mail address that is not deposited with Gravatar to comment on. We would also like to point out that it is also possible to use an anonymous or no e-mail address if users do not want their own e-mail address to be sent to Gravatar. Users can completely prevent the data from being transmitted by not using our comment system.

Soundcloud

Our podcasts are stored on the platform "Soundcloud", offered by SoundCloud Limited, Rheinsberger Str. 76/77, 10115 Berlin, Germany and are played back by this platform.For this purpose, we integrate so-called Soundcloud widgets into our website. This is playback software that allows users to play the podcasts. Soundcloud can measure which podcasts are listened to and to what extent and process this information pseudonymously for statistical and business purposes. For this purpose, cookies may be stored in the browsers of the users and processed for the purpose of creating user profiles, e.g. for the purpose of issuing advertisements that correspond to the potential interests of the users. In the case of users registered with Soundcloud, Soundcloud may associate the listening information with their profiles.The use takes place on the basis of our legitimate interests, i.e. interest in a secure and efficient provision, analysis and optimization of our audio offer in accordance with Article 6 (1) lit. f. Contact

When contacting us (e.g. via contact form, e-mail, telephone or via social media), the user's details for processing the contact request and its processing in accordance with Art. b. (in the context of contractual/pre-contractual relationships), Article 6(1)(f) GDPR. f. (other requests) GDPR. Users ' information can be stored in a customer relationship management system ("CRM System") or similar request organization.We will delete the requests if they are no longer required. We check the requirement every two years; In addition, the legal archiving obligations apply.

CRM system Zendesk

We use the CRM system "Zendesk", of the provider Zendesk, Inc., 989 Market Street #300, San Francisco, CA 94102, USA, in order to be able to process user inquiries faster and more efficiently (legitimate interest pursuant to Article 6 (1) lit. f. GDPR ).Zendesk is certified under the Privacy Shield Agreement and thus offers an additional guarantee to comply with European data protection law (https://www.privacyshield.gov/participant?id=a2zt0000000TOjeAAG&status=Active).Zendesk uses the data of the users only for the technical processing of the requests and does not pass them on to third parties. To use Zendesk, at least a correct email address is required. Pseudonymous use is possible. CRM system from Help Scout

We use the CRM system of the provider Help Scout Inc., 131 Tremont St, Boston, MA 02111-1338, USA, in order to be able to process user requests faster and more efficiently (legitimate interest pursuant to Article 6 (1) lit. f. GDPR ).Help Scout is certified under the Privacy Shield Agreement and thus offers an additional guarantee to comply with European data protection law if data is processed in the USA (https://www.privacyshield.gov/participant?id=a2zt0000000KzX1AAK&status=Active).Help Scout uses the data of the users only for the technical processing of the requests and does not pass them on to third parties. To use Help Scout, you must at least enter a correct e-mail address. Pseudonymous use is possible. Jameda Seal and Widget

Within our online offer, we integrate the seal and/or widget of the physician rating portal Jameda, offered by Jameda GmbH, St.-Cajetan-Str. 41, 81669 Munich, Germany.A widget is a functional and content element integrated within our online offer that displays changing information. The seal also works in a similar way and can contain dynamic and variable content. Although the corresponding content is displayed within our online offer, it is currently retrieved from the jameda servers. This is the only way to always show the current content, especially the current evaluation. For this purpose, a data connection must be established from the website accessed within our online offer to Jameda and Jameda receives certain technical data (access data) that are necessary for the content to be delivered. However, this data is only used to provide the content and is not stored or otherwise used.According to information from Jameda, no cookies are set by the seal or widget, nor are users of our online offer otherwise "tracked", i.e. their visit to our online offer is not recorded or otherwise stored. The IP address is processed by Jameda solely for the transmission of the widget to the browser, i.e. as a necessary technical step, and is not stored. Newsletter

With the following notices, we inform you about the contents of our newsletter as well as the registration, shipping and statistical evaluation procedure as well as your rights of opposition. By subscribing to our newsletter, you agree to the reception and the procedures described.Content of the newsletter: We send newsletters, e-mails and other electronic notifications with advertising information ("Newsletter") only with the consent of the recipients or a legal permission. If its contents are specifically described as part of a registration for the newsletter, they are decisive for the consent of the users. Newsletter-Mailchimp

The newsletter is sent by the shipping service provider "MailChimp", a newsletter distribution platform of the US provider Rocket Science Group, LLC, 675 Ponce De Leon Ave NE #5000, Atlanta, GA 30308, USA. The data protection regulations of the shipping service provider can be viewed here: https://mailchimp.com/legal/privacy/. The Rocket Science Group LLC d/b/a MailChimp is certified under the Privacy Shield Agreement and thus offers a guarantee to comply with the European data protection level (https://www.privacyshield.gov/participant?id=a2zt0000000TO6hAAG&status=Active). On the basis of our legitimate interests pursuant to Article 6(1)(f) GDPR, the shipping service provider is responsible for the shipping service provider. f. GDPR and an order processing contract pursuant to Article 28 (3) sentence 1 GDPR.The shipping service provider can use the data of the recipients in pseudonymous form, i.e. without assignment to a user, to optimize or improve its own services, e.g. for the technical optimization of the dispatch and the presentation of the newsletter or for statistical purposes. However, the shipping service provider does not use the data of our newsletter recipients to write them themselves or to pass the data on to third parties.

Google Tag Manager

Google Tag Manager is a solution with which we can manage so-called website tags via an interface (and thus, for example, integrate Google Analytics and other Google marketing services into our online offer). The Tag Manager himself (which implements the Tags) does not process users ' personal Data. Google Analytics

We rely on our legitimate interests (i.e. interest in the analysis, optimization and economic operation of our online offer within the meaning of Art. 6 sec. 1 lit. f. DSGVO) Google Analytics, a web analysis service of Google LLC ("Google"). Google uses cookies. The information generated by the cookie about users ' use of the online offer is usually transmitted to a Google server in the USA and stored there.Google is certified under the Privacy Shield Agreement and thus offers a guarantee to comply with European data protection law (https://www.privacyshield.gov/participant?id=a2zt000000001L5AAI&status=Active).Google will use this Information on our Behalf to evaluate the Users ' use of our Online offering, to compile reports on the Activities within this Online offering, and to provide further information on the use of this Online offer and the Internet use Related Services to provide us. Pseudonymous user profiles can be created from the processed data.We only use Google Analytics with IP anonymization enabled. This means that the IP address of users is being shortened by Google within Member States of the European Union or in other Contracting States to the Agreement on the European Economic Area. Only in exceptional cases, the full IP address to a server of Google in the United States is transferred and cut there.The IP address transmitted by the user's browser will not be merged with other Google data. Google Universal Analytics

We use Google Analytics in the design as "universal analytics". "Universal Analytics" refers to a method of Google Analytics in which the user analysis is carried out on the basis of a pseudonymous user ID and thus a pseudonymous profile of the user is created with information from the use of different devices (so-called "cross-device tracking").

Targeting with Google Analytics

We use Google Analytics to display the ads placed within advertising services of Google and its partners only to those users who have also shown an interest in our online offer or who have certain characteristics (e.g. interests in certain topics or products that are determined on the basis of the websites visited) that we transmit to Google (so-called "remarketing", or "Google Analytics Audiences"). With the help of the remarketing audiences, we also want to ensure that our ads correspond to the potential interest of the users.

Google Doubleclick

We use on the basis of our legitimate interests (i.e. interest in the analysis, optimization and economic operation of our online offer within the meaning of Art. 6 sec. 1 lit. f. DSGVO) the services of Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA, ("Google").Google is certified under the Privacy Shield Agreement and thus offers a guarantee to comply with European data protection law (https://www.privacyshield.gov/participant?id=a2zt000000001L5AAI&status=Active).We use the online marketing method Google "Doubleclick" to place ads in the Google advertising network (e.g., in search results, in videos, on websites, etc.).
